Which law applies
The company is incorporated in the State of Wyoming, which has no comprehensive consumer privacy statute; Wyoming law applies to us mainly through its data breach notification provisions. Because we address counterparties in Europe, we handle personal information in line with the EU General Data Protection Regulation where it applies to visitors in the European Economic Area, with the Swiss Federal Act on Data Protection where it applies to visitors in Switzerland, and with United States state privacy statutes where their thresholds are met. Where those regimes grant you stronger rights than Wyoming law, we apply the stronger standard.
What we collect
- Enquiry data. Name, company or entity, country, business email, type of enquiry, sector, jurisdictions involved, transaction stage and the content of your message, when you contact us through the enquiry form or by email.
- Onboarding and KYC data. Where a mandate is contemplated, corporate registration documents, identification documents for authorised signatories and beneficial owners, ownership and control information, and screening results.
- Technical data. Server log data generated when this website is accessed, including IP address, request time, requested resource, referrer and user agent.
Why we use it
We use enquiry data to assess and respond to your enquiry and, where relevant, to negotiate and perform a mandate. We use onboarding and KYC data to meet our own counterparty verification, sanctions screening and record-keeping requirements and to respond to documentation requests from banks, payment institutions and professional counterparties. We use technical data to operate and secure the website.
Cookies, local storage and consent
This website sets no cookies. It writes nothing to local storage or session storage, uses no device or browser fingerprinting, and loads no resource from a third-party server: fonts, images, stylesheets and scripts are all served from our own domain. Because nothing is stored on or read from your device beyond what is strictly necessary to deliver the page you requested, no consent is required and this website therefore shows no consent banner. If we ever introduce measurement or any other non-essential technology, we will ask for your consent before it is activated, offer refusal on equal terms, and record and honour your choice.
No tracking, no advertising
This website uses no analytics services, no advertising networks, no social-media plug-ins and no non-essential cookies. Fonts and all other assets are served from our own infrastructure, so visiting this website does not disclose your visit to a third-party content network. We do not sell personal information or share it for advertising, and we do not use it for cross-context behavioural advertising or automated profiling.
When you submit the enquiry form, your entries are sent over HTTPS to our website backend hosted by Vercel. The backend uses Resend to deliver your enquiry to info@tcmanagementservices.com, our company mailbox hosted by IONOS. Your email address is included as the reply-to address so we can respond directly. No mail application is required. These providers process the data needed to host, transmit and deliver the enquiry. We do not enable email open or click tracking for form notifications. Please do not submit passwords, payment-card details or sensitive documents through this form.
Legal bases
Where the General Data Protection Regulation applies, we rely on the following legal bases: handling your enquiry and performing a mandate is necessary for the performance of a contract or for steps taken at your request before entering into one; counterparty verification, sanctions screening and record retention rest on our legal obligations and on our legitimate interest in lawful and documented business relationships; operating and securing this website rests on our legitimate interest in a functioning and protected service. Where Swiss data protection law applies, the corresponding processing is justified by the conclusion or performance of a contract, by statutory obligations and by our overriding private interest in secure and documented business relationships.
Providing the information in the enquiry form is voluntary and not required by statute or contract; without it, however, we cannot assess or answer your enquiry. Providing onboarding and KYC information is required before any mandate can start.
Who receives it
Personal information is disclosed only where necessary: to our hosting and email service providers acting on our instructions; to banks, payment institutions, notaries, counsel or technical advisors where this is required to perform or onboard a mandate; and to public authorities where disclosure is required by law. Mandate information is otherwise treated as confidential under mutual non-disclosure terms.
International transfers
The company is established in the United States and works across jurisdictions. Information you send us may therefore be processed in the United States, the European Union and Switzerland. Where information is transferred, we use providers that apply appropriate contractual and technical safeguards.
How long we keep it
Enquiries that do not lead to a mandate are deleted once the enquiry is closed and no longer needed, and at the latest after twelve months. Mandate, onboarding and KYC records are retained for the duration of the relationship and afterwards for as long as commercial, tax and anti-money-laundering record-keeping obligations require. Server logs are retained for a short period for security purposes.
Your rights
Depending on where you live, you may have the right to request access to the personal information we hold about you, to request correction or deletion, to opt out of any sale or sharing of personal information (we do neither), and to be free from discrimination for exercising these rights. California residents may exercise the rights granted by the California Consumer Privacy Act, as amended. To make a request, write to compliance@tcmanagementservices.com; we may need to verify your identity before responding, and we respond within the period required by applicable law. Requests are free of charge.
Where the General Data Protection Regulation applies, you additionally have the right to restriction of processing, the right to data portability, the right to object to processing based on our legitimate interests, the right to withdraw any consent you have given with effect for the future, and the right to lodge a complaint with a supervisory authority in the Member State of your residence, place of work or the place of the alleged infringement. Where Swiss data protection law applies, you may also contact the Federal Data Protection and Information Commissioner. We take no decisions about you based solely on automated processing, and we carry out no profiling.
Note that we cannot delete information we are required to retain under anti-money-laundering, sanctions or tax record-keeping obligations.
Representatives
Our handling of personal information relating to visitors from the European Economic Area and Switzerland is occasional, is limited to business contact and onboarding information, involves no large-scale processing of special categories of data and is unlikely to result in a risk to the rights and freedoms of individuals. On that basis we do not currently designate a representative under Article 27 of the General Data Protection Regulation or under Article 14 of the Swiss Federal Act on Data Protection. We keep this assessment under review and will designate a representative, and publish its details here, if the nature or scale of our processing changes.
Children
Our services address businesses and professional counterparties. We do not knowingly collect personal information from children.
Changes
We may update this notice to reflect changes in our practices or in applicable law. The current version is always published on this page.
